AN ACT

RELATING TO GOVERNMENT; PROHIBITING ENACTMENT OR ENFORCEMENT OF ANY LAW, ORDINANCE, POLICY OR RULE THAT RESTRICTS THE USE OF PLASTIC BAGS BY A GROCERY STORE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. [NEW MATERIAL] PLASTIC GROCERY BAGS--PROHIBITED ACTION.--

          A. For the purposes of this section:

                (1) "public body" means the state or a local government or an agency or branch of the state or local government;

                (2) "local government" means a county, an incorporated city, a home rule municipality, a town or a village; and

                (3) "plastic grocery bag" means a bag that is:

                     (a) provided by a retail grocer to a customer at the point of sale for the purpose of transporting food or other goods; and

                     (b) composed of synthetic material made from linking monomers through a chemical reaction to create a polymer chain that can be molded or extruded at high heat into various solid forms, including material derived from either petroleum or a biologically based polymer, such as corn or other plant sources.

          B. A public body shall not enact, impose or continue in effect any law, ordinance, policy or rule that restricts a retail grocer's use or provision of plastic grocery bags.
